Personal Injury Claims

Injury Lawyers Serving Oregon and Northern California

Our law firm has been handling personal injury cases in state and federal courts (as well as in arbitration fora) for over 20 years. Our cases involve a wide variety of injuries and conditions: soft tissue injuries, fractures of all kinds, disc herniations, traumatic brain injury/closed head injury and quadriplegia, to name a few, as well as wrongful death actions.

Construction Accidents:

We handle cases for clients injured on construction sites by a wide variety of causes, including machinery malfunctions/failures and/or operator error, unprotected heights (scaffolds, open trenches, etc.), and electrical incidents causing brain injury, para- or quadriplegia, fractures, burns and spinal disc injuries or compression fractures. These cases require an energetic and focused effort as they often involve the general contractor as well as subcontractors, numerous depositions and site visits, and a thorough understanding of the mechanical and engineering principles involved.

Medical Negligence:

Claims against doctors, nurses, hospitals, clinics, chiropractors, dentists, naturopaths, and other medical professionals require knowledge of the medical specialty involved (e.g. cardiology, gynecology, ophthalmology, oncology, radiology, internal medicine, etc.) as well as the ability to work with independent medical experts to recognize and explain breaches of applicable standards of care (negligence). We have extensive experience settling, arbitrating and trying to conclusion cases involving medical care errors, including diagnostic and surgical errors, including Kaiser malpractice claims.

Premises Liability:

Landowners and possessors owe a duty to those lawfully on their property to use due care to keep the premises safe. We have years of experience handling cases against homeowners, shopkeepers and other property owners and lessors whose failure to keep their property free of hazards have caused injury to our clients. Examples include recovery for a humeral fracture caused by a homeowner’s faulty ladder, recovery for a hip fracture and disability caused by an unmarked island in a parking garage, and recovery for a spiral fracture of the tibia/fibula caused by a defectively designed and maintained stairway in a downtown high rise.

Auto/Truck Collisions:

Whether truck v. truck, auto v. truck, or either vehicle v. a pedestrian or cyclist, we have handled all types of vehicular collision cases, including rear-end, intersection, side-impact and head-on impacts. These cases involve recovery against commercial and private vehicle insurers, and include PIP recovery, as well. They may also involve governmental entities, such as Tri-Met or other governmental transportation providers. Injuries range from soft tissue neck and back claims to closed head injury/traumatic brain injury, to surgical and non-surgical spinal injuries to fractures (scapula, fibula/tibia, radius/ulna, jaw, etc.).

Dangerous Products:

Products liability litigation is often expensive due to manufactures’ reticence to pay promptly for injuries caused by their lucrative products. We have extensive experience with these claims, including but not limited to our litigation against the tobacco companies.

Third Party Actions:

When a worker is injured on the job by someone other than their employer, that injured worker may bring suit against the responsible party(ies). This is often referred to as a “third party claim.” These claims almost always involve a parallel workers compensation claim and are therefore more complicated. They often take a long time to resolve and often involve multiple parties, extensive discovery and multiple medical witnesses added by the workers compensation system. Since we have a workers compensation team in house, we are able to coordinate efforts and strategies to enhance each client’s recovery.

Coordination of Benefits/Efforts:

Because our practice encompasses social security, workers compensation and a wide variety of personal injury areas, we coordinate available benefits in major injury cases. Frequently, these benefits overlap, conflict, and sometimes affect each other or require repayment. Because our practice focuses on many types of illnesses and injuries, we are able to coordinate claims for benefits to maximize the recovery for our clients.

How to Reach Us:

We do not advertise on television, and if you look in the yellow pages under personal injury, you will not see a large ad touting our services. We receive most of our referrals from our clients, other lawyers, and people who work in the medical, legal, or court systems. Our lawyers and legal assistants are available and happy to speak with you to answer any questions you may have about your current situation at no cost to you.
